1. Who we are

This website and service operated at iktisaab.com, is run by Thalhaa Hussain, trading as Iktisaab, a sole trader established in the United Kingdom.

References to "we", "us" and "our" mean Iktisaab. References to "you" and "your" mean the person using the Service.

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

The Service is an online platform for learning Classical and Modern Standard Arabic using a comprehensible-input method. It provides:

  • A curated library of links to third-party video content hosted on YouTube
  • Bilingual, clickable subtitles generated and corrected using automated tools
  • Word-level morphological lookup
  • Spaced-repetition flashcards and saved learning progress

The Service is provided on an "as is" basis. We may add, change or remove features at any time. We will give reasonable notice of any change that materially reduces the value of a paid subscription.

3. Third-party video content

We do not host, own or control the video content available through the Service. All videos are hosted by YouTube and are played through YouTube's embedded player, subject to YouTube's own Terms of Service.

Subtitles, translations and linguistic annotations are produced using automated tools and may contain errors. They are provided for educational purposes and should not be relied on as authoritative translations, particularly in relation to religious texts.

If you own rights in content linked through the Service and believe it should not be included, contact us at [email protected] and we will remove the link.

4. Accounts

You must be at least 16 years old to create an account, or have the consent of a parent or guardian.

You are responsible for keeping your login details secure and for all activity on your account. Tell us promptly at [email protected] if you believe your account has been accessed without your permission.

You may not share your account, or your login details, with anyone else. Accounts are for a single individual.

5. Free and paid access

Free tier. We offer limited free access on selected videos and associated features. We may change or withdraw the free tier at any time.

Paid subscription. Full access to the library and all features requires a paid subscription, available monthly or annually. Current prices are shown on our pricing page and include or exclude tax as indicated at checkout

Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from your account settings or by emailing [email protected]. Cancellation takes effect at the end of your current billing period; you keep access until then.

We may change subscription prices. Existing subscribers will be given at least 30 days' notice before a price change takes effect, and may cancel before it applies.

6. Payment

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns.

Your contract for the purchase of a subscription is with Paddle. Paddle's Terms of Sale apply to your purchase and are available at paddle.com. This agreement governs your use of the Service itself.

7. Cancellation and refunds

Our Refund Policy forms part of these Terms and is available at https://iktisaab.com/refund-policy.

Right to cancel. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you normally have 14 days to cancel a purchase of digital content and receive a refund.

Waiver of that right. Because the Service gives you immediate access to digital content, at checkout you are asked to expressly request that access begins straight away and to acknowledge that you will lose your 14-day right to cancel once it does. If you give that consent and access begins, the statutory 14-day right no longer applies.

We nonetheless offer our own voluntary refund terms, set out in the Refund Policy. Nothing in these Terms affects your statutory rights where the Service is faulty, not as described, or not supplied with reasonable care and skill.

8. Acceptable use

You may use the Service for your own personal, non-commercial learning. You must not:

  • Copy, scrape, download, redistribute or resell subtitles, translations, flashcard data or any other material from the Service
  • Use automated tools to extract data from the Service
  • Attempt to circumvent access controls, paywalls or usage limits
  • Reverse engineer, decompile or interfere with the Service or its infrastructure
  • Use the Service unlawfully, or in a way that harms us or other users

We may suspend or terminate your account for breach of this section, without refund.

9. Intellectual property

All subtitles, translations, morphological data, flashcard content, course structure, software, design and branding created by us remain our property or that of our licensors. Your subscription grants you a personal, non-transferable, revocable licence to access this material for your own learning while your subscription is active. No other rights are granted.

10. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. The Service depends on third-party providers, including YouTube, and may be affected by their availability or by changes to their platforms.

We may suspend access for maintenance, and will try to give notice where practical.

11. Our liability

Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that:

  • We are not liable for loss or damage that was not foreseeable at the time you entered into these Terms
  • We are not liable for business losses. The Service is supplied for domestic and private use, and we have no liability for loss of profit, business, business interruption or business opportunity
  • Our total liability to you in connection with the Service will not exceed the amount you paid us in the 12 months before the claim arose

We do not warrant that translations or linguistic annotations are accurate or complete, and we are not liable for any consequence of relying on them.

12. Termination

You may close your account at any time. We may suspend or end your access if you breach these Terms, if we reasonably suspect fraud, or if we discontinue the Service.

If we discontinue the Service entirely, we will refund the unused portion of any prepaid subscription.

On termination, your licence to use the Service ends. We may delete your account data in accordance with our Privacy Policy.

13. Changes to these Terms

We may update these Terms. If a change materially affects your rights we will give at least 30 days' notice by email or in-app. Continuing to use the Service after a change takes effect means you accept the updated Terms.

14. Complaints

If something goes wrong, contact us at [email protected] and we will respond within 5 working days. For billing matters, Paddle also provides support at paddle.net.

15. Governing law

These Terms are governed by the laws of England and Wales. Disputes may be brought in the courts of England and Wales. If you live elsewhere in the UK, you may also bring proceedings in your local courts.

Consumers in the EU may also use the European Commission's Online Dispute Resolution platform.
